Life Transition: Divorce and Benefits

April 24, 2026 by Deidre Mings

What to update and Next Steps:

Divorce is a significant life event that impacts employee benefits, financial accounts, and personal records. While Missouri State University can assist with benefits-related changes, employees should also consider updates beyond workplace coverage.

This guide outlines key areas to review during and after a divorce.

Qualifying Life Event (QLE): Medical, Dental, and Vision Coverage

A divorce is considered a Qualifying Life Event (QLE) under Missouri State University benefit plans.

Key rule:

  • Coverage changes for medical, dental, and vision cannot be made until the divorce is legally final
  • The official QLE date is the date the divorce decree is finalized
  • A copy of the final divorce decree is required to process changes

Voluntary Benefits (Accident, Critical Illness, Hospital Indemnity, etc.)

Employees should also review voluntary benefits, including:

  • Accident insurance
  • Critical illness coverage
  • Hospital indemnity coverage
  • Other supplemental plans

These may require separate updates depending on plan rules and should be noted on the QLE form or reviewed with the Benefits Office.

Life Insurance and Beneficiaries

Life insurance and beneficiary designations should be reviewed after divorce.

Key points:

  • Some voluntary life insurance policies (including universal life) may be continued independently
  • Coverage for a former spouse generally ends upon divorce
  • Beneficiary updates are strongly recommended

Important caution regarding minor children as beneficiaries:

  • Minor children cannot directly receive benefits without a guardian or trust
  • This may delay access to funds or require court involvement
  • Many employees use a trust or legal guardian designation instead

Retirement Accounts and MOSERS Considerations

Employees should review:

  • MOSERS pension benefits and/or CURP retirement plan
  • 403(b) retirement accounts
  • 457(b) deferred compensation accounts

Beneficiary updates should be completed as appropriate. Retirement accounts may also be subject to division depending on the divorce agreement.

MOSERS guidance (Divorce & Your Pension Benefit, March 2026) notes:

  • Pension benefits earned during marriage are generally marital property
  • Court orders may be required for division
  • Members should review implications before finalizing agreements

Legal Name Change and Personal Records

Employees may need to update legal name and related records, including:

  • Social Security records
  • HR/payroll systems including HR’s emergency contact
  • Benefits and insurance records.

Employee Assistance Program (EAP) Support

Legal Assist Program

  • Telephonic or local attorney referral
  • Common issues: divorce, custody, estate planning, probate, and debt matters

Broader Personal & Financial Updates

Divorce also requires updates beyond University systems:

Estate Planning

  • Update wills, trusts, and powers of attorney
  • Review guardianship and beneficiary arrangements

Insurance Policies

  • Homeowners or renters insurance
  • Auto insurance (named drivers and coverage changes)
  • Non-employer life insurance policies

Healthcare & HIPAA

  • Update medical authorization forms
  • Review who can access health information or make decisions

Financial Accounts

  • Bank accounts and direct deposits
  • Credit cards and joint accounts
  • Investment account beneficiaries

Digital Access

  • Update passwords and shared accounts
  • Review subscriptions and digital services
  • Update emergency contacts

Final Thoughts

Divorce affects multiple systems beyond benefits. Reviewing coverage, financial accounts, and personal records helps ensure a smoother transition and prevents unintended outcomes.

Employees are encouraged to complete updates after the divorce is finalized and reach out for assistance when needed.
